Terms of Service

ThumbRival provides tools to analyze and preview YouTube thumbnails alongside real competitor results. You may use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the Service in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Use automated systems (bots, scrapers) to access the Service beyond normal use.
• Reverse-engineer, copy, or resell any part of the Service without written permission.

You must provide accurate information when creating an account. You are responsible for maintaining the security of your password and for all activity that occurs under your account. Notify us immediately at support@thumbrival.com if you suspect unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or are used in a manner we determine to be harmful to the Service or other users.

The Service is offered on a free tier and paid subscription plans (Starter and Pro). Paid plans are billed on a monthly or annual basis depending on the option you select at checkout. All fees are in USD and are non-refundable except as required by law.

Your subscription automatically renews at the end of each billing period. You may cancel at any time from your account page; access continues until the end of the paid period. We reserve the right to change pricing with 30 days’ notice.

Payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method for the subscription fees.

We may offer a free trial period for paid plans. At the end of the trial, you will be charged the applicable subscription fee unless you cancel before the trial ends.

You retain ownership of any thumbnail images you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to process and display that content solely to provide the Service to you.

We do not claim ownership of your thumbnails. We will not use your uploaded images for any purpose other than providing the Service, and we will not share them with third parties except as necessary to operate the Service (e.g., storing Pro history in AWS S3).

You are responsible for ensuring you have the right to upload any content you submit. Do not upload content that infringes third-party intellectual property rights.

ThumbRival uses the YouTube Data API to retrieve competitor thumbnail data. Your use of features that access YouTube data is also subject to the YouTube Terms of Service.

We also use Anthropic’s Claude API to analyze thumbnails and Stripe to process payments. Use of these features is subject to those providers’ respective terms.

The Service, including its design, code, and all non-user content, is owned by ThumbRival and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any specific results will be achieved from using the AI analysis features.

AI scoring and analysis is intended as guidance only. We make no guarantees about the accuracy of scroll-stop ratings, competitor gap analysis, or any other AI-generated output.

To the maximum extent permitted by law, ThumbRival shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, all licenses granted to you under these Terms immediately cease.

You may delete your account at any time by contacting us at support@thumbrival.com.

We may update these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you by email. Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms are governed by the laws of the jurisdiction in which ThumbRival is established, without regard to conflict-of-law principles.
